Terms of Use

These Terms of Use ("Agreement") have been concluded to define your ("User") legal obligations and rules regarding access to and use of Miella Studio's digital platforms and related services (including Meta/Instagram integrations) ("Services").

1. Acceptance of the Agreement

By visiting our website, using our systems integrated with our platforms (Instagram Support), or filling out our forms, you are deemed to have unconditionally read, understood, and accepted all rules legally outlined in these Terms of Use.

2. Intellectual and Industrial Property Rights

All digital materials, original software codes, algorithms, designs, interfaces, graphics, trademarks, and texts ("Intellectual Property") on our platform belong exclusively to Miella Studio. Users copying, reverse-engineering, allowing third parties to use, or stealing code from these materials without the written consent of the rights holder are subject to legal and criminal sanctions (within the scope of Law No. 5846 on Intellectual and Artistic Works).

3. User Obligations and Prohibited Activities

The User is obliged to fully comply with applicable laws when using our Services. The following behaviors are strictly prohibited:

• Sending cyber attacks, viruses, trojans, or any harmful software that may disrupt the operation of information systems.
• Transmitting Spam (unwanted), harmful, or content infringing on third parties' copyrights or privacy via Instagram or similar Meta services to us.
• Misusing our API services and integrations with automation tools.

4. Third-Party API Obligations (Meta Restrictions)

Our agency uses the official "Meta Graph API" services to facilitate communication with its clients. When you communicate with Miella Studio via Instagram, you agree that these messages are processed through our own admin platform. Miella Studio cannot be held responsible for deficiencies or legal interruptions in the transfer of profile photos or name information (Error 230 - User Consent) due to Meta Inc.'s current policies.

5. Limitation of Liability

Miella Studio declares that despite taking the most up-to-date security measures in its systems, it cannot be held responsible under any circumstances for commercial, indirect, incidental, or consequential damages arising from data loss or service interruptions that may occur as a result of cyber attacks, power/internet infrastructure failures (force majeure).

6. Governing Law and Jurisdiction

The laws of the Republic of Turkey shall apply to the implementation, interpretation, and all legal disputes arising from these Terms of Use; the exclusive jurisdiction for the resolution of disputes shall be the Istanbul (Çağlayan) Courts and Enforcement Offices.

7. Effectiveness and Amendment Rights

Miella Studio reserves the right to unilaterally amend these terms without prior notice in accordance with legal regulations or operational needs. The amendments become effective as soon as they are published on the site.
